Recent changes in the Turkey's trademark classification system

The latest (11th) edition of the International Classification of Goods and Services for the Purposes of the Registration of Marks (Nice Classification) entered into force on January 1, 2017 and brought significant additions and amendments to the previous one.

The Turkish Patent and Trademark Office revised the Turkey's classification of goods/services for trademark application purposes mostly in compliance with the recent edition of the Nice Classification and it has been in force since January 1st, as well.

This update seems to require some trademark owners, especially in cosmetics and beauty, textile and personal accessorizes industry to register and/or to monitor their trademarks in different classes for proper protection of their trademarks.

Particularly, the Classes 03, 05, 10, 11, 35, 42 and 45 were remarkably modified and followings are the major updates in the Turkey's recent national classification system;

  • Cosmetics and soap for medical purposes added to the Class 05, while cosmetics and soap in class 03 were limited to the ones not including medicine,
  • Wearable electronics (smart watches, smart bracelets etc.) added to the Class 10 and bracelets and rings for medical purposes (rheumatism prevention bracelets and rings) were added to the Class 11, while watches, bracelets and rings have been listed under the Class 14,
  • Electronic heated socks were added to the Class 11, while socks have been listed under the Class 25,
  • Electronic cigarettes and their refills were added to the Class 34,
  • Design services for advertising purposes were added to the Class 35, while design services other than engineering, computer and architectural design; graphic arts designing in class 42 were limited to the ones not being for the purpose of advertising and landscaping.
  • Providing sellers and consumers with online marketing websites were added to the Class 35.
  • "Social Network Creating Services" were added to the Class 45
